On 27 October 2021, the Supreme Court found in favour of a group of Unite members whose employer, Kostal Ltd – a car components manufacturer from Rotherham – had sought to undermine their union negotiations by offering unlawful inducements to undermine a union ballot rejecting a pay offer. The original dispute involved around 60 union members at Kostal. Unite and its members were represented throughout by Thompsons Solicitors LLP.
Speaking for Thompsons’ Trade Union Law Group, Richard Arthur, said: “This is the most important trade union rights case in over a decade – and the first case in the UK’s highest court on trade union bargaining rights.
“It protects the fundamental right of workers to meaningful collective bargaining and has widespread implications for every unionised workplace.
“Thompsons is proud to have worked alongside Unite to achieve this historic victory.”
