1. What is whiplash?

Whiplash is caused when a person suffers from a sudden jolt to their head or body, which damages muscles, ligaments, tendons or other soft tissues in the neck.

Whiplash is probably the most common type of injury sustained following a road traffic accident, however, it can be caused by many different situations including slips, trips and falls, sports injuries and even assaults and attacks.

A whiplash injury can cause pain, stiffness and restriction of movement in the neck area, and can also cause headaches, muscle spasms and pain in the shoulders or arms. In more serious cases of whiplash, there can be swelling, back pain, pins and needles in the arms, hands or fingers, dizziness, lethargy and nausea.

In most cases, the injured person will not develop symptoms of whiplash immediately after their accident. The symptoms of whiplash will develop a day or two afterwards and may get worse over a period of time before starting to get better. While some people make a recovery within a few days or weeks, others are left with symptoms and pain from their whiplash injury for months or even years.

2. Aren’t whiplash claims “dodgy”?

The insurance industry and the government say that there is an “epidemic” of whiplash claims and that many of the claims being made are fraudulent. The government is trying to introduce new laws that will restrict the amount of compensation that a whiplash claimant can get. As a firm, Thompsons Solicitors will obviously never act for someone who is falsely claiming that they have whiplash; however, we don’t agree with the government or insurers that there is an “epidemic” of false whiplash claims. That is not our experience.

We believe that the insurance industry and government are using whiplash claims as an excuse to limit people’s access to lawyers and compensation generally.

Yes. If the driver drove off or is uninsured, our team of whiplash lawyers can still help you by putting in an application to the Motor Insurance Bureau (MIB).

5. How long have I got to make a whiplash claim?

Like all claims for road traffic accidents, you have three years from the date of the accident in the UK to make a whiplash claim.

There are a few exceptions to the three-year limit, however, the sooner you seek legal advice, the quicker we can prepare your claim and apply for any interim payments you may be entitled to.

Contact Thompsons Solicitors as soon as possible to begin your whiplash injury claim.

6. How long will it take to get compensation from my whiplash claim?

Thompsons Solicitors’ priority is to quickly gather the facts of your accident and the medical evidence to support your whiplash injury claim and secure compensation as quickly as possible.

7. How much whiplash compensation will I get?

The whiplash claim amount can vary, as it will depend on the extent of the injury and the impact it has had on your daily life. We can help you claim for all losses and expenses incurred and give you an indication of the amount you could receive.
